SMS/Texting Policy
Effective: June 24, 2026
Purpose; Scope. This SMS/Texting Policy (this “Policy”) governs the sending of text messages (including SMS, MMS, and RCS Texts) by the Lucas Museum of Narrative Art (“LMNA” or the “Museum”) to individuals (each, a “Recipient”) who provide a mobile telephone number to the Museum and sign up for one of our recurring and occasional one-time or limited duration Text message programs, including marketing programs, with Texts relating to reminders, exhibit information, special promotions, volunteering, and/or events, and other Museum-related transactional and/or marketing messages (“Museum Messages”), unless a specific set of additional terms are provided. This Policy applies to Museum Messages sent by the Museum and, where applicable, by service providers acting on the Museum's behalf. By signing up for Museum Messages, you also agree to this Policy, as well as our general Terms of Use, which are incorporated and considered a part of this Policy, grant us certain rights and licenses, provide us certain indemnities, waive certain of your rights and remedies, and limit our liability and obligations to you. In addition, as set forth in our Terms of Use, any dispute, controversy, or claim between the parties arising out of or relating in any way to this Policy will be resolved by binding individual arbitration conducted by JAMS (“JAMS”) under its rules. Please also review our Privacy Policy, which sets forth how we use the information we collect from you. To the extent of any inconsistency between this Policy and another Museum policy, this Policy will apply to our text message programs.
Consent to Receive Texts; No Condition of Purchase. By providing a mobile telephone number to the Museum and affirmatively opting in to Museum Messages where requested, including by electronic agreement, the Recipient provides agreement authorizing the Museum to send Texts to the Recipient at the mobile number provided, including by an automated telephone dialing system (autodialer) and/or prerecorded or artificial voice technology (“Automated Technology”) (collectively “Express Written Consent”) to the extent permitted by applicable law. The Recipient understands and agrees that providing Express Written Consent to receive Museum Messages is not a condition of purchasing any goods or services from the Museum. To opt in to receive Texts from a Museum text messaging program at the mobile phone number you provide when signing up or any other number you designate, please follow the instructions provided by the Museum, which may include providing your phone number online at our website, texting a message to a telephone number or short code, or by otherwise providing your consent. You may need to confirm your consent such as by replying Y or through another designated response to an initial text message sent to you.
Permitted Content; Frequency; Costs. Museum Messages may include (a) reminders (including ticketing, reservations, timed entry, automated queueing, membership, or program reminders), (b) information about exhibits and Museum offerings, (c) special promotions and/or events, (d) volunteering, and (e) other transactional and/or marketing messages. We may send reminders based on your activity on our website, such as abandoned cart reminders, browse abandonment (e.g., information and alerts based on the offerings or products you viewed on our website), matters related to your account, and post purchase follow-ups (e.g., offers related to the Museum, recommendations based on previous purchases, survey, or sweepstakes opportunities), which may be based on our use of cookies or other tracking technologies when you view content while logged onto the website. Message frequency may vary. Standard message and data rates may apply depending on the Recipient's mobile plan and carrier; the Museum does not charge for Texts but the Recipient is responsible for any carrier charges.
Recipient Representations. The Recipient represents that (a) the mobile number provided is accurate, (b) the Recipient is the customary user and/or authorized subscriber of that mobile number, (c) the Recipient has authority to provide consent to receive Museum Messages at that number, (d) the Recipient is at least 18 years of age or the age of majority on their jurisdiction, and (e) the Recipient is a resident of the United States. You further agree that you will opt out of receiving text messages from the Museum by texting STOP to the number for the text message program from which you no longer wish to receive messages (i.e., the number from which its text messages are being sent) prior to ending your use of the mobile phone number).
Opt-Out; Revocation of Consent. The Recipient may revoke consent by replying "Stop" to any Museum Message. You may receive a final confirmation of opt-out.
Help; Contact. For additional assistance, the Recipient may use the Museum's published contact channels (including terms.legal@lucasmuseum.org) as made available by the Museum. You can also reply HELP to the number from which you receive the Museum Messages.
Availability. If your mobile operator is not participating, you will not receive a reply to your messages. Some operators may not support some services (e.g., pre-paid users may not be able to participate). Check with your carrier to confirm. The Museum and mobile carriers are not responsible or liable for any undue delays, failure of delivery, or errors in messages. Not all mobile devices may be supported, and our messages may not be deliverable in all areas.
Cancellation The Museum may suspend or terminate your receipt of Museum Messages if the Museum believes you are in breach of this Policy or the Museum Terms of Use. Your receipt of Museum Messages is also subject to termination in the event that your mobile telephone service terminates or lapses. The Museum reserves the right to modify or discontinue, temporarily or permanently, all or any part of Museum Messages, with or without notice.
Changes to Policy. The Museum may update this Policy from time to time. Continued participation in Museum Messages after the effective date of an update constitutes acceptance of the updated Policy. We may also notify you by other means, such as sending a text message to the number you used to sign-up for our text message program(s).
